As cases back up for years in court and the costs associated with litigation rise, more courts are requiring alternative resolutions before a lawsuit is allowed to go to trial, and many contracts specify binding arbitration or mediations as the only means to settle a dispute between the parties to the contract.

Randell C. Stoney, Jr., a third-generation Charleston attorney, has focused his 35+ year law practice on construction law, premises and product liability, and general liability. R. Scott Wallinger, Jr. heads up Barnwell Whaley’s trucking and transportation practice and focuses his 25+ year law practice in the areas of trucking defense, professional liability defense, complex business litigation, and mediations. He is certified as a mediator by South Carolina Supreme Court Arbitrator and Mediator Certification Board and is an approved Circuit Court mediator.

Justin P. Novak, special counsel at Barnwell Whaley, concentrates his practices in the areas of professional liability, premises liability and construction law. Though frequently engaged for the most complex litigation cases, Novak offers mediation services for those wishing to avoid costly litigation.

John W. Fletcher, special counsel at Barnwell Whaley, has been practicing law since 1997, primarily in the most complex matters in the firm’s civil litigation and appellate practices.  With experience in all levels of state and federal courts, including the United States Supreme Court, Fletcher now offers mediation services for his clients to settle their matters outside of the courtroom.
